1. Eligibility:
a. This Offer is open to individuals who meet the following criteria:
i. Must be legal resident of the United States or Canada;
ii. Must be at least 18 years of age or older at the time of the participation;
iii. Must make a qualifying purchase as specified in the Offer details.
2. Offer Period and Territory:
a. The Offer is valid in the United States and Canada from June 8 to 19, 2023. Purchases outside of these dates and countries will not be considered.
3. Qualifying Purchase:
a. To qualify for the Offer, customers must meet the specified requirements, which include, but are not limited to:
i. Minimum purchase amount before tax, as specified in the “USA & Canada Retail promotion”;
ii. This Offer is only valid on Pelican International Inc.’s brands: Pelican, Perception, Wilderness Systems, Advanced Elements, and Boardworks;
iii. This offer is valid for purchases made at Pelican International, Confluence Outdoor, and Advanced Elements authorized retailers in the United States and Canada;
iv. Retail and consumer sales only; not applicable on any other sale than from the retailers
4. Offer details:
a. Each request must be complete to be valid:
i. Complete the online request as specified. All fields and requested pictures are mandatory, otherwise the request will not be proceeded;
ii. Include a visible copy of your original, dated store receipt and paid price. Estimates, work orders and quotes are not acceptable as proof of purchase;
iii. Include the serial number from the kayak or the board you purchased as a proof of purchase and a picture of that serial number.
b. Online claims must be received no later than July 19, 2023.
c. The prepaid virtual credit card will be sent by email to the email address provided within 6 weeks after July 19, 2023.
5. Limitations:
a. Pelican International Inc. reserves the right to substitute the Offer with any item equal or greater value if necessary;
b. The Offer is subject to availability;
c. The Offer is non-transferable and cannot be exchanged or redeemed for cash or any other alternative;
d. The Offer is limited to one (1) redemption request per purchase of one (1) Pelican, Perception, Wilderness Systems, Advanced Elements, or Boardworks watercraft. Limit of one (1) redemption per transaction, per address and per email address. Each request must have all listed items to be valid;
e. The offer is applicable solely to watercrafts and does not extend to any other products, including accessories. The Offer cannot be combined with any other promotions, discounts, or offers;
f. Other restrictions may apply.
6. Disqualification and Modifications:
a. Pelican International Inc. reserves the right to disqualify any participant who violates these Terms and Conditions or engages in any fraudulent or abusive behavior;
b. Pelican International Inc. reserves the right to modify or terminate the Offer at any time without prior notice, for any reason, at its sole discretion;
c. All decisions made by Pelican International Inc., or its authorized representatives relating to the validity of any participation to the Offer are final and binding.
7. Liability:
a. Pelican International Inc. is not responsible for any loss or damage by participants or any third party in connection with the Offer;
b. By participating in the Offer, participants agree to release and hold Pelican International Inc. harmless from any claims, demands, or liabilities arising out of or related to the Offer.
8. Governing law and Jurisdiction:
a. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Quebec. Any disputes arising out of or in connection with the Offer shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec.
9. Severability:
a. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Entire Agreement:
a. These Terms and Conditions constitute the entire agreement between the participant and Pelican International Inc. regarding the Offer and supersedes any prior agreements or understandings, whether written or oral.
